Terms and Conditions

This page contains the Terms and Conditions that apply whenever you (the "client," "consumer," or "customer") purchase or engage with services from Gianni.im Limited (referred to as "I" or "me"). These terms are designed to provide a transparent understanding of roles and responsibilities between you and Gianni.im Limited.


Online Services and Online Coaching


1.Services - Bespoke 1-2-1 Online Coaching:


A personalised service where I will coach you on workouts, nutrition, and lifestyle adjustments to help you achieve your specific goals. You will receive tailored training plans, weekly check-ins, and individualised nutrition advice.


1.A Online Accountability Partner: 


A service where we will communicate through text throughout the week. I will monitor your progress and hold you accountable to the goals you've set. No personalised training or nutrition plans are provided in this service - only written accountability and metric tracking.


1.B Contract and Commitment:


The minimum commitment for any Online Coaching is 3 months, unless otherwise agreed and clearly stated in your starting invoice. You are required to pay for these months regardless of your attendance.

  

After the minimum commitment period ends, your subscription will automatically continue on a monthly rolling basis until you cancel it.


Cancellation of Automatic Renewal: 


To cancel the subscription, please provide written or digital notice at least 30 days before the next payment cycle. Failure to cancel on time will result in automatic renewal.


If you are under 18, written consent from your legal guardian must be provided.


1.C Payment for Online Coaching and Online Services:


A starting invoice will be sent to you before your Online Coaching begins, this includes before we begin to build your set up. Payment must be made through the specified payment provider. Following this, an automatic monthly payment will be set up, and payments will be due on the same date each month.


You are responsible for keeping your payment details updated. If a payment fails, you will get one reminder and 24 hours, then the system will lock out your profile and you will lose all access until payment has been settled.


1.D Pause or Cancel Online Coaching:


You can pause Online Coaching for up to 30 days by giving written or digital notice at least 5 days before your desired pause date. During this pause, no charges will apply.


After the minimum contract has been completed, you may cancel your contract with a 1-month cancellation notice. For example, if you notify us on 11th May, the end of your initial 3 months, your contract will end on 11th June. If you do not notify us then your next payment will be due on the 11th June.


If you wish to terminate your contract before completing the minimum 3-month commitment, you will still be required to pay for all remaining payments.


Online Coaching cannot be transferred to someone else, as all services are tailored to you personally.


1.E Right of Return for Online Coaching and Online Services:


You have the right of return for 14 days from the date of your first purchase, provided the service has not already been started. If you have had your bespoke plan built and sent then there will only be 60% of your investment returned. 


If you have begun Online Coaching or any other service (meal plan, training plan, or Online Accountability), refunds will not be issued for any payments already made, but future payments will be canceled.


1.F Disclaimer for Online Coaching and Online Services:


Online Coaching, meal plans, training plans, and any other online services are carried out at your own risk. While I am dedicated to improving your physical well-being, I am not a qualified medical professional, psychologist, dietician, or mental health expert. 


If you are dealing with health issues, injuries, eating disorders, or mental health conditions, it is important to consult a relevant healthcare professional before engaging in any of my services. 


I am not liable for worsening any existing health conditions if they are not disclosed prior to starting the service.


I retain the right to use any pictures, statements, or testimonials you send me for promotional purposes, such as on social media and my website. We will always ask for your consent first, and will never share your name or face without permission.

2. Personal Training Sessions (In-Person)


2.A Services:


Personal training involves 1-on-1 in-person sessions where I will guide you through a workout tailored to your goals. 


You are entitled to a free introductory consultation, during which we will discuss your goals and give you a workout program to suit your goals.


Sessions take place in my private studio or at your home (if agreed upon). A personal training session lasts for 60 minutes, including a warm-up, workout, and cool-down.


Session Frequency:


 1x per week = 4 sessions per month

 2x per week = 8 sessions per month

 3x per week = 12 sessions per month


2.B Payment for Personal Training:


Your invoices must be paid no later than 2 days before your first session. The sessions are paid for in advance of the dates one month in advance.


An invoice will be sent each month, and payment must be made via bank transfer according to the details listed on the invoice. If you have any comments or questions about the invoice or these Terms and Conditions, please contact me after receiving the invoice.


All payments must be made within the specified deadline, on receipt of the invoice.


2.C Cancellation Policy for Personal Training


If you need to cancel or reschedule a session, please notify me as soon as possible:


More than 48 hours' notice: Session can be rescheduled or canceled without charge.


Between 48 and 24 hours' notice: We will attempt to reschedule the session in the same week. If rescheduling is not possible, a cancellation fee of £30.00 will be charged.


Less than 24 hours' notice: The session is cancelled and full payment will be charged without the possibility of rescheduling.


2.D Stopping Personal Training:


To stop personal training, please provide written or digital notice. You may also naturally stop when all your purchased sessions have been completed.

2.E Right of Return and Validity for Personal Training


Sessions are valid for 90 days (3 months) from the date of purchase. After this period, any unused sessions will be considered expired.


You have the right of return for 14 days from the first purchase date. If you have already started personal training, amounts already paid will not be refunded, but all future payments will be canceled.


If you wish, you may transfer any remaining sessions to another person, with written or digital notice to Gianni Fabrizio.


2.F Disclaimer for Personal Training:


Personal training is carried out at your own risk and you will be required to complete a PARQ questionnaire.


While I am committed to supporting your physical goals, I am not a medical doctor, psychologist, or certified nutritionist. If you have any health issues, injuries, eating disorders, or mental health conditions, please disclose them before beginning personal training.


I am not responsible if training sessions lead to worsening of any undisclosed health conditions if not made aware prior to starting any sessions.


3. GDPR and Data Privacy


Before starting any coaching (online or in-person) or receiving a meal plan, you will be sent a questionnaire and a ParQ form so I can prepare a personalised training plan for you. I will only ask for information that is relevant to your health and goals. If you prefer not to answer a specific question, please inform me.


During coaching, I may record personal information, such as weight, height, muscle mass, and measurements, to track your progress and adjust your training. You will also be submitting these details weekly as part of your accountability and progress tracking.


All personal data is stored securely on my password-protected account via Hubfit. Your personal folder is retained for up to 24 months in case you wish to restart coaching. However, before/after pictures and testimonials may be kept indefinitely for promotional purposes.


If you ever wish to have your pictures or data removed, please contact me directly.


Your name and email will be added to my newsletter list, and you may receive promotional emails. You can unsubscribe from these emails at any time.


4. Additional Comments


These Terms and Conditions supersede any previous Terms and Conditions you have received or found attached to your invoices. Please refer to the most recent version available on this page.


Changes to the Terms and Conditions: 


I may update these Terms and Conditions from time to time. The date of the most recent update will be displayed at the top of this page. By continuing to use my services, you agree to the updated terms.


Force Majeure:


In the event of unforeseen circumstances, such as illness, natural disasters, or other force majeure events, the implementation of coaching programs or personal training sessions may be affected. In such cases, I will work with you to reschedule sessions or adjust plans accordingly.


Conflict Resolution:


If a disagreement arises between us, I am committed to resolving the issue fairly and constructively. We will work together to reach a mutual resolution through open communication and collaboration.
